Introduction

These Terms and Conditions ("Terms and Conditions") apply to the Line 6 Helix Cashback Promotion ("Promotion") which is offered by Yamaha Music Australia Pty Ltd ACN 004 259 527 (“YMA”, "we", "us", "our") to participating eligible customers.

By participating in the Promotion, you agree to these Terms and Conditions.

Promotion Period

The Promotion is valid from [1/03/2025] to [31/5/2025] ("Promotion Period"). Purchases made outside the Promotion Period are not eligible for the Promotion. References to time are to the time in Melbourne, Australia.

Eligibility

1. The Promotion is open to eligible customers who purchase any of the products listed in the “Eligible Product” column of the following table from an authorised YMA dealer within the Promotion Period:

2. The Eligible Product must be:
   1. paid in full by the customer; and
   2. in stock and available for delivery (or delivered),
   during the Promotion Period, and prior to a claim being submitted in the Promotion to YMA by the customer.
3. Eligible customers who purchase an Eligible Product during the Promotion Period and who otherwise comply with these Terms and Conditions are eligible to receive the Cashback Amount listed next to the Eligible Product in the above table (“Cashback Amount”).
4. Employees of YMA and their immediate family members are not eligible to participate in the Promotion.

Redemption Process

1. To receive the Cashback Amount, you must:
   1. purchase and pay for the Eligible Product in full during the Promotion Period;
   2. submit a Claim Redemption Form. The Claim Redemption Form must be completed by [30/6/2025];
   3. provide proof of purchase as directed by YMA and/or the Claim Redemption Form, including a receipt or invoice number evidencing:
      1. that the Eligible Product has been paid in full;
      2. that the Eligible Product is in stock and available for delivery;
      3. the date of purchase and payment, the name of the YMA authorised dealer, together with the model number and a valid serial number;
   4. otherwise comply with these Terms and Conditions.
2. The Cashback Amount will be paid in Australian dollars by electronic funds transfer into the customer's nominated Australian bank account within 60 days of YMA accepting a claim.

General Conditions

1. The Promotion cannot be combined with any other offer, discount, or promotion.
2. YMA reserves its rights to determine the validity of any claim made in the Promotion at its absolute discretion.
3. Eligible customers will be notified via their nominated email address that their claim has been accepted by YMA.
4. If a customer who has received a Cashback Amount returns its corresponding Eligible Product, the customer must notify YMA in writing and refund the Cashback Amount in full to YMA within 30 days.
5. If a customer returns an Eligible Product after a Claim Redemption Form has been submitted, the customer must notify YMA that the Eligible Product has been returned and the customer's right to receive the Cashback Amount will be immediately forfeited.
6. The price of any Eligible Product is at the discretion of the participating authorised YMA dealer.

Limitation of Liability

1. To the extent permitted by law, YMA is not responsible for any loss or damage arising from or in connection with the Promotion, including but not limited to delays in assessing any claim or paying any Cashback Amount.
2. YMA accepts no responsibility for any late or misdirected claims.
3. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights which may not be excluded, restricted or modified (by agreement or otherwise) under the Competition and Consumer Act 2010 (Cth) ("CCA") or any other applicable legislation. If the CCA or any other applicable legislation implies a condition, warranty or term into these Terms and Conditions or provides statutory guarantees in respect of goods and services supplied (if any), then YMA's liability for breach of such a condition, warranty, other term or guarantee is limited to the repair or replacement of the relevant goods or the resupply of the relevant services.

Privacy

Any personal information collected in connection with the Promotion will be handled in accordance with our Privacy Policy, which is available at [Privacy Policy Link].

Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Amendments

We reserve the right to amend these Terms at any time. Any amendments will be effective immediately upon being posted on our website.
